Peter Edwards and Ben McCormack (barrister) will present this challenging day.

Most of us have the right to make unwise decisions.
However, in the murky and untidy world of incapacity, life is not like that.
The MCA is clear, if you lack capacity to engage in sexual relations, that is it, you cannot do it. Even if you have been married to that person for 60 years.

The Court of Protection has been grappling with this thorny subject for many years. There are also many related aspects.

This course will cover ;

Engaging in and consenting to sex
Preventing sex through the back door (limiting contact)
The right to pay for sex (and can staff facilitate this)
Capacity to understand the other person’s  ability to consent.
Capacity to marry
Vulnerability to sex through social media
Contraception and sterilisation
Termination of pregnancy
Capacity to agree to IVF

“Very helpful, approachable, very knowledgeable speakers, an excellent mix of practice and law, absolutely loved the day as did the rest of the participants. Discussion and questions were encouraged throughout the day, there was not a dull moment. The course covered all the topics as indicated by the course material”.

“Excellent very useful course in a niche area of law it is always difficult to find good training opportunities for”.

 “A very informative and interesting course with very engaging speakers”.

 “The course was very informative and thought provoking and as the norm from one of Peter’s training sessions you feel inspired to spread the word however, I wish there had been more information around how or who should pick up the baton to approach the court of Protection etc.  otherwise another excellent course”.

“Very grateful and appreciative of attending the Course. Very much enjoyed reading the PowerPoint presentation with details of all cases ahead of event.”
